Antidumping
Duty Investigations: Steel Concrete Reinforcing Bars from Belarus,
Indonesia, Latvia, Moldova, the People's Republic of China, Poland,
the Republic of Korea, and Ukraine
On January
17, 2001, the Department of Commerce (DOC) announced the preliminary
determinations in the above-referenced investigations.
PETITIONERS:
The petitions
were filed on behalf of the Rebar Trade Action Coalition (RTAC),
and its individual members, AmeriSteel, Auburn Steel Co., Inc.,
Birmingham Steel Corp., Border Steel, Inc., Marion Steel Company,
Riverview Steel and Nucor Steel, and CMC Steel Group. Auburn Steel
Co. is not a petitioner in the investigations involving rebar from
Japan and Indonesia.
CRITICAL
CIRCUMSTANCES ALLEGATIONS:
The Department
has preliminarily found that critical circumstances do not exist
with respect to imports from Korea, Latvia and Belarus. The Department
has previously determined preliminarily that critical circumstances
do exist with respect to imports from Modolva, the PRC, Poland and
Ukraine. If the DOC finds, or continues to find, critical circumstances
in the final determinations and the International Trade Commission
(ITC) also finds critical circumstances, imports of these products
will be liable for duties 90 days prior to the DOC's preliminary
determinations of sales at less than fair value.
PRODUCT
DESCRIPTION:
The merchandise
subject to this investigation is all steel concrete reinforcing
bars (rebar) sold in straight lengths, currently classifiable in
the Harmonized Tariff Schedule of the United States (HTSUS) under
item number 7214.20.00 or any other tariff item number. Specifically
excluded are plain rounds (i.e., non-deformed or smooth bars)
and rebar that has been further processed through bending or coating.

* In the cases
involving Belarus, Korea, Latvia, and the PRC, the DOC has extended
the deadline for the final determinations to 135 days after the
date of publication of the preliminary determinations.
** Estimated
If the DOC
makes an affirmative final determination, the ITC must make a final
injury determination by the later of 120 days after the date of
our preliminary determination or within 45 days after our final
determination. If that determination is affirmative, DOC will issue
a duty order.
