Antidumping
Duty Investigations: Steel Concrete Reinforcing Bars from Belarus,
Latvia, Moldova, the People's Republic of China, and the Republic
of Korea
On June 15, 2001, the
Department of Commerce (the Department) announced the final determinations
in the above-referenced investigations.
PETITIONERS:
The petitions were filed
on behalf of the Rebar Trade Action Coalition (RTAC), and its individual
members, AmeriSteel, Auburn Steel Co., Inc., Birmingham Steel Corp.,
Border Steel, Inc., Marion Steel Company, Riverview Steel, Nucor
Steel and CMC Steel Group.
CRITICAL
CIRCUMSTANCES ALLEGATIONS:
In its preliminary determination,
the Department found that critical circumstances exist with respect
to imports from Moldova, the People's Republic of China, and one
company (i.e., Hanbo Iron & Steel Co., Ltd.) from the
Republic of Korea. However, for these final determinations, the
Department has found that critical circumstances exist with respect
to imports from the People's Republic of China, and Hanbo Iron &
Steel Co., Ltd. from the Republic of Korea. In addition, the Department
has also found that critical circumstances do not exist with respect
to imports from Belarus, Latvia, Moldova, and the remaining Korean
companies.
If the International
Trade Commission also finds that critical circumstances exist, imports
from the above-referenced countries/company will be liable for duties
90 days prior to the Department's preliminary determinations of
sales at less than fair value.
PRODUCT DESCRIPTION:
The merchandise subject
to these investigations is all steel concrete reinforcing bars (rebar)
sold in straight lengths, currently classifiable in the Harmonized
Tariff Schedule of the United States (HTSUS) under item number 7214.20.00
or any other tariff item number. Specifically excluded are plain
rounds (i.e., non-deformed or smooth bars) and rebar that
has been further processed through bending or coating.
CASE CALENDAR:
The following determinations
will be made not later than these statutory deadlines:
ITC Final Determination
July 30, 2001*
Order August 6, 2001*

Since the Department
has made affirmative final determinations, the ITC must make final
injury determinations within 45 days after our final determinations.
If these determinations are affirmative, Department will issue duty
orders in one week.
