Final Determination of Sales at Less Than Fair Value:
Solid Agricultural Grade Ammonium Nitrate from Ukraine

Background:

The petition in this proceeding was filed on October 13, 2000 by the Committee for Fair Ammonium Nitrate Trade, whose members are domestic producers of solid agricultural grade ammonium nitrate. On November 8, 2000, after a careful review of the allegations contained in the petition, the Department initiated an antidumping duty investigation on ammonium nitrate from Ukraine. On February 26, 2001, the Department announced the results of the affirmative preliminary determination finding antidumping duty margins of 113.38 percent for the company investigated and all other Ukranian producers.

On July 18, 2001, the Department reached a final determination in this proceeding, finding antidumping duty margins of 156.29 percent for the company investigated and all other Ukranian producers.

Product Description:

The products covered are solid, fertilizer grade ammonium nitrate ( "ammonium nitrate") products, whether prilled, granular or in other solid form, with or without additives or coating, and with a bulk density equal to or greater than 53 pounds per cubic foot. Specifically excluded from this scope is solid ammonium nitrate with a bulk density less than 53 pounds per cubic foot (commonly referred to as industrial or explosive grade ammonium nitrate). The merchandise subject to this investigation is classified in the Harmonized Tariff Schedule of the United States at subheading 3102.30.00.00.
